14. Dispute Resolution

Informal Resolution First

If you have a dispute with Real Property Resolution Group, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute informally. We will respond within thirty (30) days. If we cannot resolve the dispute through informal discussion within sixty (60) days, either party may proceed to formal dispute resolution as described below.

Binding Arbitration

Except for the carve-outs described below, any dispute arising out of or relating to these Terms or your use of the Website that cannot be resolved informally will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in Guilford County, North Carolina, or by remote means if both parties agree. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court with jurisdiction.

Carve-Outs from Arbitration

Notwithstanding the above, the following matters are not subject to mandatory arbitration:

• Claims that may be brought in small claims court within that court’s jurisdictional limits
• Claims for injunctive or other equitable relief to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights
• Any other claims that applicable law prohibits from being subject to mandatory arbitration

Class Action Waiver

You and Real Property Resolution Group agree that any dispute resolution proceeding will be conducted only on an individual basis, not as a class action, collective action, or representative action. The arbitrator may not consolidate or join the claims of multiple parties.

Time Limit

Any claim arising from or related to these Terms or the Website must be brought within one (1) year of the date the claim arose, except as otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by a revised “Last updated” date at the top of these Terms. If we make material changes, we may also notify you by other reasonable means.
